Authority to provide the services offered by Utah Sentencing Alternatives and the requirements that due consideration is given to the information provided are outlined in:

Rule 22 of the Utah Rules of Criminal Procedure requires the Court to provide an opportunity for the defense to provide reasonably reliable and relevant information regarding sentencing.

Utah Code § 77-18-1 (5) (a) Prior to the imposition of any sentence, the court may, with the concurrence of the defendant, continue the date for the imposition of sentence for a reasonable period of time for the purpose of obtaining a presentence investigation report from the department or information from other sources about the defendant.
